GENERAL SITE TERMS
Conditions of Sale
No contract between Michele Webber and the Buyer shall exist until the Buyers order has been accepted by Michele Webber. The goods shall remain the property of Michele Webber until cleared payment has been received.
Privacy Policy
Michele Webber respects the privacy of every individual who visits her website/s. She will not share personal information or email addresses with anyone unless specifically requested by the buyer, or when requested to do so by court order or law enforcement agency.
Minors
We do not knowingly collect personal information from children under the age of 13. If we learn that we have personal information on a child under the age of 13, we will delete that information from our systems.
Links to other sites
We are not affiliated with nor does linking imply endorsement to sites that may be linked to this site and we are not responsible for their content. Sites to which we link are for your convenience only and you access them at your own risk.
Confidentiality of codes, passwords and information
You agree that you will not under any circumstance register or purchase under the name of another person. You are responsible for all use of the site made by you or anyone else using your user name and password and for preventing their unauthorized use.
PAYMENT
Methods
All credit card transactions occur over a secure connection. Michele Webber does not store credit card numbers. You may purchase by Paypal even if you do not hold an account with them.
If you wish to pay by cheque please get in touch via the Contact Me page. Goods purchased by cheque will only be dispatched after the cheque has cleared.
Notes about fraud
Michele Webber reserves the right to refuse any payment made by the Buyer without giving reason to the Buyer and to refuse orders from certain countries that are known for fraudulent activities.
FRAMING
Due to the expense and difficulty of insuring glazed work all pieces on this site are sold unframed. Some smaller pieces and prints may come mounted, please see individual listings for exact details. I am happy to arrange framing for anyone who is able to collect from my studio in Suffolk. Please enquire via the Contact Me page if you are interested in this service.
Fading and conservation issues
Each piece of artwork is sent out with a sheet of helpful information and tips. Only stable pigments and high quality materials are used to produce artwork. Nevertheless artworks on paper are fragile. It is vital that the work is properly framed and correctly hung. Absolutely no claims or responsibility will be entertained for degradation of work that has been improperly framed or hung in an unsuitable environment. Fading can also be minimized and usually avoided by careful hanging Please note that by their very nature collaged pieces are more liable to fading. This should be considered as an intrinsic part of the artwork, and the artist is not responsible for this. DISPATCH TIMES
Postal services & times
Artwork is sent out by First Class Recorded Delivery. Lower value goods such as cards are sent by First Class Post. If another type of postal service is required please ask.
Wherever possible artwork will be dispatched within 2 working days. However (particularly in the case of large paintings and one-off prints/pieces) it is possible that a piece of artwork may need to be retrieved from an exhibition, or may even be required to be kept on exhibition for a certain time period. The buyer will be kept fully informed at all times and refunded if they are not happy to wait.
Artwork listed on this site may also be listed on other internet shop sites, or displayed in shops or galleries. In this instance (although highly unlikely) it is possible that the piece may have already been sold elsewhere before the buyer makes payment. In this case a full refund will immediately be offered. If possible (for example in the case of a series of prints) we will endeavor to offer a similar piece, acceptance of which is entirely at the discretion of the buyer.
RETURNS
How to return
If you are not satisfied with your artwork or simply do not like it, you may return it within 14 days for a full refund. Refunds will be made by cheque or Paypal transfer depending on the original payment method. Work must however be returned in pristine condition and in the original packaging or similar new packaging. Any cellophane covering/labels must not have been removed. Work that is sent back damaged will not be refunded. You are liable for the costs of returning artwork. Work should be sent by recorded delivery or other traceable method, you must if necessary, be able to prove it was returned.
Loss/Damage in Transit or Non-delivery
In the case of goods damaged in transit when sent out, they must be carefully returned to me as stated above. A refund will be issued at my discretion.
COPYRIGHT
Copyright ownership
Copyright protection applies not only to products offered for sale on this website but also to all text and images posted by Michele Webber within the website generally and elsewhere on the internet. Original artwork, writing and associated products such as greetings cards must not be reproduced in any form whatsoever for commercial or non commercial purposes. Copyright law also states that a signature on an original piece of art work must not be covered, removed or in any way altered or defaced.
Purchase of artwork on this site does not include any rights to copyright, unless subject to a specific contract signed by both parties. Specifically the Buyer is purchasing the piece only, not the copyright.
Exceptions
It is permitted under law to reproduce limited images as part of a literary or artistic review. However this must be considered under law as ‘reasonable use’. Michele Webber is also happy for students to use images for PERSONAL study only; they must not be reproduced in bulk or shared with others without permission of Michele Webber. Under no circumstances must images be reproduced in magazines or other publications (including internet sites) in order to gain commercial profit. Any use of images that is not liable under law to be ‘reasonable use’ will be considered infringement and recompense will be actively sought by Michele Webber via legal means.
Persons or websites wishing to use images in a legal, credited way for the mutual benefit of both parties may contact Michele Webber by email with details for consideration.
Infringement of copyright
Michele Webber takes infringement of copyright very seriously. Any infringement of copyright will result initially in Michele Webber seeking an injunction to stop further infringements. After this damages and compensation will be sought via legal proceedings. Any sites publishing images or writings by Michele Webber will be expected to remove such from their sites as soon as attention is drawn to this.
